COMPETITION AND GIVEAWAYS

BREED OF THE MONTH TERMS AND CONDITIONS

  • Must be happy to travel to our destination studio in Wootton NSW or to one of our beautiful Great Lakes dog-friendly beaches
  • Valid for sessions booked within 3 months after the Breed of the Month applied for.
  • Only one voucher may be redeemed per photo session
  • Not transferable, refundable or redeemable for cash and cannot be combined with any other offer
  • Your design and purchasing appointment is scheduled within 2 weeks of your photography session to redeem your artwork credit
  • All dogs must be up to date with their vaccinations to attend a session on our farm
  • Dogs are selected at the discretion of Jo Lyons Photography. Submitting an application does not guarantee acceptance into this month's breed of the month.
  • If your dog is selected to participate, you agree to sign a model release form that allows Jo Lyons Photography reasonable use of the photography of your dog. This may include promotional uses, printing, publishing, display, and use on the Jo Lyons Photography website and social media accounts.
  • A $100 holding fee is due at the time of booking your Breed of the Month experience

DOG OF THE YEAR TERMS AND CONDITIONS

  • Must be happy to travel to our destination studio in Wootton NSW
  • Vouchers cannot be used in conjunction with any other offer, are not transferrable for cash, are non-refundable, and are valid for photography experiences booked between 1 March and 30 June of the year entered.
  • Only one vote is allowed per person.
  • Any voting deemed to be fraudulent or illegal will result in disqualification at Jo Lyons Photography's discretion.
  • By entering, you agree to receive emails from Jo Lyons Photography from which you may unsubscribe at any time. I promise not to pass your details to any third party nor will I spam you.
  • Your design and purchasing appointment is scheduled within 2 weeks of your photography session to redeem your artwork credit
  • All dogs must be up to date with their vaccinations to attend a session on our farm

PHOTOGRAPHY BOOKING TERMS AND CONDITIONS

1. BOOKING

If applicable, your total session fee is to be paid in full, and these Terms and Conditions must be signed and submitted within five business days to secure your appointment. Your session fee payment is non-refundable if your booking is cancelled by you.

If you are booking on a gift certificate or prize, or as a returning client, a $100 holding fee is required, and these Terms and Conditions must be signed and submitted within five business days to secure your appointment.

This holding fee is non-refundable for cancellations, however, will be refunded or credited toward your order at the reveal and purchasing appointment.

Any offers or specials are for up to two dogs from the same household. Additional dogs can be added to the session booking for a fee of $50 per additional dog.

2. CANCELLATION POLICY

Cancellations for photo sessions or purchasing appointments more than 48 hours from your appointment cannot be refunded but can be rescheduled. Cancellations within 48 hours of your appointment cannot be refunded or rescheduled, and a new session fee is required to reschedule in these cases for a new appointment.

Due to the studio booking schedule, if you are 15 minutes late or more for your appointment, I will have to reschedule your appointment to a later date/time.

3. FARM WORK HEALTH AND SAFETY

  • Any behavioural issues must be disclosed prior to booking.
  • Please only bring the dog/s booked into your session as per the questionnaire. If you wish to add additional animals after booking, please check if the studio has availability for this before your appointment.
  • Should your dog/s come into season, or suffer from any illness or infectious disease, please advise asap, and I will need to reschedule your session.
  • Upon arrival at the farm/studio, please ensure your dog is leashed and secured before exiting your vehicle.
  • The entire farm, including the studio and car park area, is a non-smoking/non-vaping property.
  • All dog excrement must be picked up and disposed of by the family of the dog.
  • Vaccinations/titer tests, tick and flea treatments must be up to date.
  • Please also ensure you check yourself and dog/s' thoroughly after the session for ticks.
  • A copy of your dog/s' current vaccination/titer test certificate/s must be emailed to info@jolyonsphotography.com within 7 days of booking confirmation. The session cannot go ahead without this documentation.

4. THE DESIGN AND PURCHASING APPOINTMENT

One Design and Purchasing Appointment is allocated per photo session, and this is your only buying opportunity. This needs to be scheduled within two weeks of your photo session to utilise any applicable artwork credit issued.

All decision-makers must attend both the photography session and purchasing appointment to claim the full value of the voucher.

This session will take approximately one hour. Any applicable artwork credit is forfeited for any orders not placed in the purchasing appointment.

Should a second purchase appointment be required, a fee of $195 per hour (min 1 hr) applies. It is the client's responsibility to ensure any other financial decision-makers are made aware of the product list and pricing prior to the Purchasing Appointment.

Payment Options at your Purchase Appointment are:

a)  Pay in full (Amex, Visa, MasterCard)

b)  Interest-Free Payment Plan with Payright (30% deposit payable upon purchase) or Afterpay for purchases over $1000

c)  An in-house lay-by agreement (30% deposit payable upon purchase)

Order cancellations need to be made in writing within 72 hours of order (prior to manufacture/printing); however, editing fees of $25 per image are applied. Outside of 72 hours, all payments will be forfeited, and editing fees of $25 per image are applied.

Images will be archived 30 days after your purchase appointment and a fee of $195 will be required to retrieve them after this time. If an additional purchase of $1,000 or more is made, the retrieval fee will be credited against the order. The unordered archived images will be purged 12 months after the photo session. Purchased images will be retained in the archive for safekeeping.

5. IMAGE USE AND COPYRIGHT

By completing this form and confirming your session, you give the Studio the unrestricted right and permission to copyright and use, re-use, publish and republish the photographic portraits taken, through any and all media known for illustration, art, and promotion or advertising. You also relinquish any right to examine or approve the completed product or advertising copy or printed matter which may be used.

Images may not be used by clients for competitions, commercial marketing purposes, or as reference material for artworks. If images are shared on social media they must not be altered in any way, must not have logos removed (if applicable), and must be credited to Jo Lyons Photography in all instances.

6. INDEMNIFICATION

The Photographer shall be held harmless for any and all injury to you, your dog or other pets and your property during the course of the photography session and the immediately surrounding events.

7. CIRCUMSTANCES

If the Photographer is unable to perform the session due to the dog/pet’s disposition, condition, or circumstances listed within this contract, the Client shall be allowed to reschedule at the Studio's discretion. The Studio shall attempt to resolve any circumstances not to exceed fifteen (15) minutes in length.  Rescheduling shall occur within a reasonable time in the same calendar year as the original session.

8. FAILURE TO PERFORM

If the Photographer is unable to perform this agreement due to illness, or emergency or causes beyond her control, the Studio and Client shall make every attempt to reschedule the session. If a reschedule is unable to be agreed upon, the Studio shall return the retainer to the Client and shall have no further liability.  Further, if the Studio is unable to deliver photographic materials due to technological malfunctions, including but not limited to camera and processing, or otherwise lost or damaged without fault of the Photographer, liability shall be limited to returning any retainer paid.
